These Terms of Use ("Terms") govern your access to and use of the Portability mobile application and website (the "Service") operated by AI Lead Lab, LLC ("we", "us", "our"). By accessing or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service you represent that you meet this age requirement and have legal capacity to enter into these Terms. Users under 18 must have a parent or legal guardian review these Terms.
2. The Service
Portability provides travel planning information, port and airport guides, local offer discovery, and FX (foreign exchange) savings estimates. Information may be incomplete, delayed, or modified by third parties. The Service is provided for informational and convenience purposes only.
3. FX Estimates Are Not Financial Advice
FX outputs are estimates for trip planning and comparison only. Portability is not a money services business, money transmitter, broker-dealer, or financial advisor. We do not provide currency exchange, custody of funds, remittance services, banking services, or investment advice in the mobile MVP. You should consult licensed professionals before making financial decisions.
4. Offers And Third-Party Content
Local offers, merchant listings, travel guides, and external links may be fulfilled or provided by third parties. Terms, availability, pricing, and redemption are controlled by the relevant provider. We are not responsible for third-party content, products, or services.
5. Referral Program
The referral model is direct-only and web-managed. Eligible paid tiers may earn 20% recurring commission on direct paid subscription referrals. Free-tier users may invite others but do not receive cash payouts at launch. No second-tier overrides are included in the MVP. Full referral terms are presented at sign-up.
6. Acceptable Use
You agree not to: (a) misuse the Service or attempt unauthorized access; (b) reverse engineer or decompile the Service; (c) use the Service for any unlawful purpose; (d) interfere with the security or integrity of the Service; or (e) scrape, harvest, or otherwise collect data from the Service in bulk without our written consent.
7. Account & Account Deletion
You are responsible for maintaining the security of any credentials you create. You may delete your account at any time from within the app (Account screen → "Delete My Account") or by emailing support@portabilityapp.net.
8. Intellectual Property
The Service, including its content, design, code, branding, and trademarks, is owned by AI Lead Lab, LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. All rights not expressly granted are reserved.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI LEAD LAB, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100 USD) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless AI Lead Lab, LLC from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your misuse of the Service; or (c) your violation of any law or the rights of a third party.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration to take place in Miami-Dade County, Florida. You waive the right to a jury trial and to participate in any class action.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason in our sole discretion. The provisions of these Terms that by their nature should survive termination (including Sections 8–12) shall survive.
14. Changes
We may update these Terms. Material changes will be notified via the app or by email. Continued use after changes take effect constitutes acceptance.
